DR. NOW Terms of Service

Effective Date: July 7, 2026

These Terms of Service govern your access to and use of the Brand Now Holdings LLC (doing business as and referred to herein as "Dr. Now") website, products, subscriptions, messaging, coaching and wellness features, and other non-clinical services made available by Dr. Now.

Key points

Please read these Terms carefully. The most important points are:

·       Dr. Now is not a medical provider and does not provide medical advice, diagnosis, or treatment.

·       Clinical consultations, medical evaluations, prescribing, and related telehealth services are provided by OpenLoop Healthcare Partners, PC and/or affiliated professional entities, not by Dr. Now.

Program billing, cancellations and refunds for the clinical program are administered by OpenLoop or its designated billing affiliate under the OpenLoop Refund and Cancellation Policy.

·        Dr. Now is not forming a doctor-patient relationship. 

·       The patient portal may display Dr. Now branding, but it is operated by OpenLoop or its service providers, not by Dr. Now.

·       Dr. Now does not collect health-related screening data before OpenLoop and does not collect, store, access, or receive health or medical data in or from the OpenLoop clinical workflow.

·       Any health or medical information you provide in the OpenLoop clinical workflow is collected, maintained, and governed by OpenLoop and its own patient-facing documents.

·       Dr. Now collects only non-clinical commercial, account, payment, support, marketing, and website usage information needed to operate its platform.

·       Dr. Now products sold through its commercial channels are separate from telehealth services.

·       These Terms include limitations of liability, a dispute resolution process, and an arbitration and class action waiver section.

·       If you are experiencing a medical emergency, call 911 immediately. Dr. Now and OpenLoop are not emergency services.

1. Scope and acceptance

These Terms form a binding agreement between you and Brand Now Holdings LLC (Dba "Dr. Now").

By accessing or using the services, creating an account, purchasing a product, subscribing to a program, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the services.

You must be at least 18 years old to use the services, and you represent that the information you provide to Dr. Now is accurate and complete.

2. What Dr. Now does

Dr. Now operates a consumer-facing brand and platform. Depending on the offering, Dr. Now may provide educational content, consumer products, website features, subscriptions, account management, customer service, wellness or coaching features, and technology that helps users connect with third-party services.

Dr. Now does not practice medicine, employ your treating clinician for the OpenLoop workflow, direct clinical judgment, prescribe medications, diagnose conditions, or provide emergency care.

No use of Dr. Now’s website, products, subscriptions, or services creates a doctor-patient relationship with Dr. Younan Nowzaradan personally.

3. OpenLoop clinical services

If you choose to pursue clinical services, those services are provided by OpenLoop Healthcare Partners, PC and/or affiliated professional entities under separate documents, disclosures, and consents.

The OpenLoop-operated patient portal may display Dr. Now branding, but that portal is operated by OpenLoop or its service providers. Your relationship for clinical care, telehealth, diagnosis, prescribing, and medical records is with OpenLoop and the applicable provider entities, not with Dr. Now.

Dr. Now does not collect health-related screening data before OpenLoop and does not collect, store, access, or receive health or medical data in or from the OpenLoop clinical workflow.

4. Account and commercial information

To use certain Dr. Now services, you may need to create an account or provide commercial information such as your name, email address, phone number, shipping information, billing information, payment information, subscription selections, and communications preferences.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify Dr. Now promptly if you believe your account has been accessed without authorization.

Dr. Now may suspend or terminate accounts that are inaccurate, fraudulent, abusive, unlawful, or otherwise in violation of these Terms.

5. Coaching and wellness services

If Dr. Now offers coaching or wellness support, those services are non-clinical unless Dr. Now expressly states otherwise in separate provider-facing documentation.

Coaches do not diagnose conditions, prescribe medication, provide therapy, or replace licensed medical care. Coaching content is educational and supportive only.

Users should seek appropriate medical care from qualified licensed providers for medical questions, emergencies, medication issues, or treatment decisions.

6. Products, orders, subscriptions, and billing

Dr. Now may offer physical products, memberships, subscriptions, and related services for purchase. By placing an order or enrolling in a subscription, you agree to pay all charges presented at checkout, including applicable taxes, shipping, recurring subscription fees, and any other disclosed charges. Charges may appear under Dr Now or another descriptor associated with Brand Now Holdings LLC.

Enrollment and Authorization

If you enroll in a "Subscribe & Save," auto-delivery, replenishment, or similar subscription program, you authorize Shop Dr. Now and our payment processors to automatically charge your designated payment method and ship eligible products on the frequency you select until you pause, skip, modify, or cancel your subscription.

Renewal, Pricing, and Notice

Your subscription renews automatically at the then-current subscription price, plus applicable taxes, shipping, and fees, unless canceled. Promotional pricing may apply only for the period disclosed at sign-up. We will provide order confirmations, subscription confirmations, renewal notices, price-change notices, and cancellation instructions as required by applicable automatic-renewal laws, including state automatic-renewal statutes.

Managing or Canceling

You may manage, pause, skip, change frequency, update flavors or products, update payment information, or cancel through your account portal or by contacting cancel@drnowmd.com. To avoid the next charge, cancellation or modification must be completed before the next scheduled billing or processing date. Requests received after an order enters fulfillment may apply to the following cycle.

No Post-Shipment Subscription Refund Right

Canceling a subscription stops future renewal charges but does not automatically refund previously processed or shipped orders. Returns and refunds for subscription products are governed by Section 10 and any product-specific disclosures at checkout.

7. Cancellations and refunds

Dr. Now may allow cancellation through account settings, support, or another method identified at enrollment.

Apparel and Merchandise

Unworn, unwashed apparel and non-perishable merchandise in original condition with tags and packaging may be returned or exchanged within 30 days of delivery, unless marked final sale. Refunds may be issued to the original payment method or as store credit, less shipping, handling, return shipping, or restocking fees disclosed at checkout or in the return portal.

Dietary Supplements, Vitamins, and Electrolytes

For health, safety, tamper-evidence, and hygiene reasons, opened, used, damaged, unsealed, punctured, partially consumed, expired, or safety-seal-broken supplements, vitamins, electrolyte tubs, stick packs, sachets, bottles, or ingestible products are final sale and not eligible for return or exchange. Unopened, unused, unexpired products in original sealed packaging may be returned within 14 days of delivery unless marked final sale. Damaged, defective, incorrect, or missing items must be reported within 7 days of delivery with order information and photos where requested.

Skincare and Cosmetics

Opened, used, unsealed, tested, damaged, or safety-seal-broken skincare or cosmetic products are final sale and not eligible for return or exchange due to hygiene and safety considerations. Unopened, unused products in original packaging may be returned within 14 days of delivery unless marked final sale. Damaged, defective, incorrect, or missing items must be reported within 7 days of delivery.

Exercise Equipment

If Dr. Now MD offers exercise equipment or other products that are identified on the applicable product page as subject to this section, those products may be returned within [30] days after delivery, provided they are unused, unassembled, in their original packaging, and accompanied by proof of purchase.

Unless otherwise stated on the applicable product page, the customer is responsible for return-shipping costs. A restocking fee of up to [15%] may be deducted from the refund where permitted by law and where disclosed before purchase.

Products that are used, assembled, damaged after delivery, missing parts, or identified as final sale are not eligible for return, except where required by law or where the product arrived damaged or defective.

**Open Loop Clinical Program Charges, Cancellations and Refunds**

Clinical services and treatment-eligibility decisions are provided and administered by OpenLoop Healthcare Partners, PC and/or the applicable OpenLoop-affiliated professional medical entity. Program billing, cancellations and refunds are administered by OpenLoop or its designated billing affiliate.

Dr. Now MD does not provide clinical care, determine treatment eligibility, prescribe medication, or independently approve or process refunds for clinical services or the clinical program. Eligibility for any cancellation or refund is governed by the OpenLoop Refund and Cancellation Policy presented during enrollment and available through the OpenLoop-operated patient portal.

Requests concerning clinical-program charges, cancellations or refunds must be submitted through the OpenLoop-operated patient portal or through the OpenLoop support contact identified during enrollment.

Subscription Services

  • Your membership in the subscription program (“Subscription Service”) begins once you have completed the intake form and paid for the first month of the Subscription Services.

  • Please note if you are disqualified by our healthcare provider for a medical reason you will receive a full refund.

  • The Subscription Services include access to healthcare providers, medications where appropriate, and online support. 

  • There is no guarantee of results or effectiveness of any treatment or care plan provided to you as part of your participation or use of the Subscription Services.

which govern the Subscription Services.

Cancellation Policy

  • You may cancel your Subscription Service at any time for any reason. To cancel your Subscription Services, please contact customer support at in your patient portal and request a cancellation or through your online account/patient portal (if applicable). 

  • To ensure a smooth process, we require your cancellation request to be received at least 72 hours prior to your next billing date. If prior notice is not received in this window, your subscription will be charged in accordance with the then-current billing cycle, and the cancellation will take effect on the subsequent billing cycle.

  • After cancellation, you will continue to receive the Subscription Services through the end of the then-current billing cycle. 

  • Please see our Refund Policy below to determine if you are eligible for a refund for your canceled Subscription Service. 

Refund Policy

  • If your Subscription Service is cancelled by notifying patient support at within the first 72 hours of your Subscription term and you have not received any Subscription Services, you will be issued a full refund.

  • If your Subscription Service is cancelled due to disqualification by our healthcare provider, you will be issued a refund for your Subscription Service charges following the disqualification. 

  • If your Subscription Service is charged monthly, YOU WILL NOT BE ISSUED A REFUND UPON CANCELLATION FOR THE MONTH IN WHICH THE CANCELLATION OCCURED OR FOR ANY PRIOR MONTHS.

  • If your Subscription Service is charged 2 or more months at a time, you will be issued a refund for the months for which no medication was shipped to you. 

  • Other than as outlined above, IN NO EVENT WILL YOU BE ISSUED A REFUND UPON CANCELLATION OF THE SUBSCRIPTION SERVICES.

  • Federal law generally prohibits the return of prescription medications to pharmacies for refund or reuse once they have been ordered for a patient. This policy ensures that all medications are handled and dispensed with utmost care and compliance. Damaged or Incorrect items: Please inspect your items immediately upon receipt.  If any of the items appears to be damaged or incorrect, please immediately contact customer service.  

    • Damaged items: Damaged items may be replaced by the pharmacy upon receipt of evidence of damage. 

    • Incorrect items: Incorrect items will be replaced by the pharmacy.  

Subscription Services FAQs

  • What is included in my Subscription Services price?

    • Your Subscription Services represents a single price for the subscription purchased. This may include consultations both live and via electronic form submissions and reviews by a healthcare provider for medications that are fulfilled through a pharmacy, lab services, or other health care services for which we collect payments, 24/7 patient support line, and other services to support your medical journey. 

  • What if my healthcare provider determines I am no longer eligible for the Subscription Services?

    • If your healthcare provider determines you are no longer eligible for the Subscription Services, your subscription will be canceled, and a refund may be issued. If you have questions or concerns about an eligibility-initiated cancellation, please contact our patient support at the contact email or phone number in the patient portal.

8. Privacy

Your use of Dr. Now’s services is also subject to the Dr. Now Privacy Policy.

Dr. Now collects only non-clinical commercial, account, payment, support, marketing, and website usage information needed to operate its platform. Dr. Now does not collect health-related screening data before OpenLoop and does not collect, store, access, or receive health or medical data in or from the OpenLoop clinical workflow.

Health or medical information submitted in connection with OpenLoop clinical services is governed by OpenLoop’s own patient-facing privacy, telehealth, and consent documents, including its Notice of Privacy Practices where applicable.

9. Acceptable use

You agree not to misuse the services. This includes, without limitation, using the services to violate law, infringe intellectual property rights, interfere with site operations, attempt unauthorized access, submit false or misleading information, harass or abuse personnel, scrape or reverse engineer protected site functionality, or resell products or subscriptions where prohibited.

Dr. Now may investigate suspected misuse and may suspend or terminate access or take other action as permitted by law.

10. Intellectual property

The Dr. Now website, branding, logos, text, graphics, software, educational content, and other materials made available through the services are owned by Dr. Now or its licensors and are protected by intellectual property laws.

Subject to these Terms, Dr. Now grants you a limited, revocable, non-exclusive, non-transferable license to access and use the services for personal, lawful, non-commercial purposes. No other rights are granted.

11. No medical warranty

Dr. Now does not guarantee any clinical outcome, prescription, insurance coverage result, eligibility determination, product effect, coaching result, or weight-loss outcome.

Information made available through Dr. Now is provided for general informational and educational purposes only and is not a substitute for professional medical advice or care.

Any decision to prescribe medication, provide treatment, or deliver telehealth care is made solely by the applicable OpenLoop provider or affiliated clinical entity in its independent professional judgment.

Fitness and Exercise Disclaimer

Any exercise equipment, fitness guides, or workout recommendations are provided for informational purposes only. Use of fitness equipment involves inherent risk of physical injury. You assume all risk of injury associated with the use of Dr. Now exercise products and agree to consult a physician before beginning any new exercise regimen.

FDA Dietary Supplement Disclaimer

STATEMENTS REGARDING VITAMINS, ELECTROLYTES, DIETARY SUPPLEMENTS, INGREDIENTS, AND RELATED WELLNESS PRODUCTS HAVE NOT BEEN EVALUATED BY THE U.S. FOOD AND DRUG ADMINISTRATION. THESE PRODUCTS ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, MITIGATE, OR PREVENT ANY DISEASE. Dietary supplements are regulated as foods, not drugs, and are not approved by FDA for safety or effectiveness before marketing in the same manner as pharmaceutical drugs.

Cosmetics and Skincare Disclaimer

Skincare and cosmetic products are intended to cleanse, beautify, promote attractiveness, or alter appearance and are not intended to diagnose, treat, cure, mitigate, or prevent disease, skin disorders, infections, or medical conditions. No claim on the Site is intended to characterize a cosmetic product as a drug. Perform a patch test before first use and discontinue use if irritation, rash, redness, swelling, burning, or adverse reaction occurs. Seek medical advice for persistent or severe symptoms.

12. Third parties

The services may involve or link to third-party sites, providers, pharmacies, laboratories, payment processors, shipping vendors, communications vendors, and other partners.

Pharmacy Services

By accepting these Terms of Use, you additionally understand and agree that Dr Now MD is not acting as a pharmacy, nor does Dr Now MD control or interfere with any such services. By accepting these Terms of Use, you understand and agree that you may be entering into a relationship with a pharmacy, pharmacist, and/or pharmacy group or other such relationship with any one or more such third-party entities.

Dr. Now is not responsible for third-party services, content, policies, products, or acts or omissions, except as required by law. Separate terms and policies may apply to third-party offerings, including OpenLoop clinical services.

State Coverage

Open Loop currently offering services in all 50 states plus Washington D.C. Some services may not be available in all 50 states or Washington D.C. Subject to change. 

13. Disclaimers

To the maximum extent permitted by law, the services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted availability.

Dr. Now does not warrant that the site or services will always be available, secure, error-free, or free of harmful components.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

14. Limitation of liability

To the maximum extent permitted by law, Dr. Now will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or business opportunities arising out of or related to the services.

To the maximum extent permitted by law, Dr. Now’s total aggregate liability for any claim arising out of or relating to the services or these Terms will not exceed the greater of one hundred dollars ($100) or the amount you paid directly to Dr. Now for the applicable service in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Dr. Now and its affiliates, officers, directors, employees, contractors, licensors, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the services, your violation of these Terms, your violation of law, or your infringement of another party’s rights.

16. Arbitration and class action waiver

Please read this section carefully. It affects your legal rights.

To the maximum extent permitted by law, claims arising out of or relating to these Terms or the Dr. Now services will be resolved through binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

You and Dr. Now each waive any right to a jury trial and any right to participate in a class action, class arbitration, mass arbitration, private attorney general action, or other representative proceeding, to the extent permitted by law.

Counsel should confirm the final arbitration administrator, venue, mass arbitration language, opt-out mechanics, and any state-specific limitations before publication.

17. Governing law

These Terms are governed by the laws of Texas, without regard to conflict-of-laws rules, except to the extent superseded by federal law or consumer protection rules that cannot be waived.

18. Changes to these Terms

Dr. Now may update these Terms from time to time. When updated, the revised version will be posted with a new effective or last updated date.

If changes are material, Dr. Now may also provide notice through the website, email, or another appropriate channel. Your continued use of the services after updated Terms become effective constitutes acceptance of the revised Terms.
